Pre-incarceration Planning

Individuals facing incarceration should make legal arrangements for their child's care while they are incarcerated. The best option will depend on individual circumstances, and consultation with a family law attorney is recommended. Individuals facing short-term incarceration, can sign a "power of attorney" to give someone the power to make decisions for their children while incarcerated. Individuals facing longer term incarceration may need to make more permanent arrangements, like a guardianship, to ensure that the children do not end up in foster care.
